AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, AMENDING CHAPTER 17.21 OF THE HERMOSA BEACH MUNICIPAL CODE REGARDING ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY DWELLING UNITS TO COMPLY WITH RECENT CHANGES IN STATE LAW AND DETERMINE THE PROJECT IS EXEMPT UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO SECTION 21080.17 OF THE CALIFORNIA PUBLIC RESOURCES CODE
NOTICE IS HEREBY GIVEN that on January 28, 2025, the City Council of the City of Hermosa Beach (“City”) adopted Ordinance No. ORD-24-1484.
Ordinance No. ORD-24-1484 amends Chapter 17.21 to make changes to the City’s regulations on accessory dwelling units (ADUs) and junior accessory dwelling units (JADUs) to comply with recently adopted State law and to defer to the adopted Building Code regarding building separation. Specifically, this Ordinance does the following: (i) prohibits the City from denying an ADU or JADU that was constructed before January 1, 2020 unless that City finds that correcting a violation of the ADU or JADU is necessary to comply with standard specified in Health and Safety Code section 17920.3; (ii) prohibits the City from requiring replacement parking when an uncovered parking space is demolished for or replaced with an ADU; (iii) incorporates the State mandated definition of “livable space;” (iv) amends the City’s regulations on detached ADUs for lots with existing multifamily dwelling units to reflect the new maximum number of allowed detached ADUs; and (v) modifies the required building separation between ADUs and another habitable structure to defer to the Building Code. The Ordinance is exempt from the California Environmental Quality Act pursuant to section 21080.17 of the Public Resources Code.
Ordinance No. ORD-24-1484 was introduced for first reading by the City Council of the City of Hermosa Beach at its regular meeting on November 14, 2024, modified at the January 14, 2025, City Council meeting, and adopted on January 28, 2025, City Council meeting by the following vote: AYES: Councilmember Keegan, Mayor Pro Tem Saemann, and Mayor Francois; NOES: Councilmembers Detoy and Jackson; ABSTAIN: None ABSENT: None
