NOTICE OF ADOPTION AND SUMMARY
 
URGENCY ORDINANCE NO. ORD-24-1480U

AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, ADDING CHAPTER 8.42 TO THE HERMOSA BEACH MUNICIPAL CODE PROHIBITING THE USE OF FIREWORKS IN THE CITY AND AMENDING SECTION 1.10.040 OF THE HERMOSA BEACH MUNICIPAL CODE TO MAKE VIOLATIONS OF CHAPTER 8.42 SUBJECT TO ADMINISTRATIVE CITATIONS, AND DETERMINE THE URGENCY ORDINANCE IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)

NOTICE IS HEREBY GIVEN that on June 25, 2024, the City Council of the City of Hermosa Beach (“City”) adopted Ordinance No. ORD-24-1480U. Ordinance No. ORD-24-1480U adds Chapter 8.42 and amends section 1.10.040 to the Hermosa Beach Municipal Code related to fireworks in the City. Specifically, Ordinance No. ORD-24-1480U prohibits the use possession and sale of any kind of firework in the City. Further, the ordinance also prohibits anyone from permitting the use or sale of fireworks from their property. Violations of this ordinance are made subject to administrative citations at increasing fine amount due to the number of times violated (i.e., $1,500 for 1st, $3,000 for 2nd and $5,000 for 3rd and beyond). Violations of section dealing with allowing one’s property to be used for the sale or use of fireworks are subject to flat $5,000 citation amounts. Finally, this ordinance was adopted via urgency in order to order to protect the public health, safety, or welfare of the City and its residents and visitors and is exempt from the California Environmental Quality Act.

The Urgency Ordinance was adopted by the City Council of the City of Hermosa Beach at its regular meeting held on June 25, 2024 by the following vote: AYES: Councilmembers Jackson, Detoy, Saemann, and Mayor Pro Tem Francois; NOES: Mayor Massey; ABSTAIN: None ABSENT: None
