NOTICE OF ADOPTION AND SUMMARY
URGENCY ORDINANCE NO. ORD-24-1478U

AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, ADDING SECTION 10.12.175 TO THE HERMOSA BEACH MUNICIPAL CODE REGARDING SAFETY AND OPERATIONAL REGULATIONS RELATED TO ELECTRIC/MOTORIZED  BICYCLES IN THE CITY, AMENDING SECTION 1.10.040 TO MAKE VIOLATIONS OF CERTAIN MUNICIPAL CODE REGULATIONS RELATED TO ELECTRIC/MOTORIZED BICYCLES SUBJECT TO ADMINISTRATIVE CITATIONS, ADDING CHAPTER 5.82 DEALING WITH THE RENTAL OF ELECTRIC BICYCLES IN THE CITY AND DETERMINE THE URGENCY ORDINANCE IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)

NOTICE IS HEREBY GIVEN that on June 4, 2024, the City Council of the City of Hermosa Beach (“City”) adopted Ordinance No. ORD-24-1478U.

Ordinance No. ORD-24-1478U adds section 10.12.175, adds Chapter 5.82, and amends section 1.10.040 to the Hermosa Beach Municipal Code related to electric/motorized bicycles in the City. Specifically, Ordinance No. ORD-24-1478U regulates the riding of electric and other motorized bikes in the City by: (i) prohibiting the riding or operating of an electric bicycle or any other electric or motorized conveyance in a way that constitutes danger to themselves or others; (ii) requiring all riders under the age of 18 to wear properly strapped helmets, (iii) prohibits riding of electric bikes and other motorized conveyances on the Greenbelt; (iv) prohibits the operating of a bicycle, electric bicycle or any motorized/electric conveyance under the influence of alcohol or drugs; (v) prohibits the transportation of a passenger on an electric bicycle or any motorized/electric conveyance is prohibited unless the passenger uses a separate seat that is attached to the conveyance; and (vi) requires the rental of electric bicycles to be equipped with technology to prohibit the use of the motor in areas where not permitted in the City. Violations of this ordinance as well as other bicycle and electric bicycle regulations are made subject to administrative citations and juveniles under the age of 18 who are cited for violating the Ordinance may have their electric bicycles impounded. Finally, this ordinance was adopted via urgency in order to order to protect the public health, safety, or welfare of the City and its residents and visitors and is exempt from the California Environmental Quality Act.

The Urgency Ordinance was adopted by the City Council of the City of Hermosa Beach at its special meeting held on June 4, 2024 by the following vote: AYES: Councilmembers Jackson, Detoy, Saemann, Mayor Pro Tem Francois and Mayor Massey; NOES: None; ABSTAIN: None ABSENT: None The Ordinance will take effect immediately.
