NOTICE OF ADOPTION AND SUMMARY OF ORDINANCE NO. 23-1469
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING ZONE TEXT AMENDMENT 23-03, TO AMEND PORTIONS OF THE HERMOSA BEACH MUNICIPAL CODE TITLE 17 RELATING TO COMMERCIAL CANNABIS ACTIVITIES AND MOBILE CANNABIS DISPENSARIES AND DETERMINE THE AMENDMENT IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)
NOTICE IS HEREBY GIVEN that on September 26, 2023 the City Council of the City of Hermosa Beach (“City”) adopted Ordinance No. 23-1469 to amend portions of the Hermosa Beach Municipal Code Title 17 relating to commercial cannabis activities and mobile cannabis dispensaries and determine the amendment is exempt from the California Environmental Quality Act.
Ordinance 23-1469 amends portions of Title 17 (Zoning) of the Hermosa Beach Municipal Code relating to cannabis delivery. This ordinance modifies land use regulations to allow delivery of cannabis by businesses with physical locations outside City limits, which obtain a permit described by Chapter 5.80 of the Hermosa Beach Municipal Code. Delivery would be allowed in all zones, except OS – Open Space. Only the delivery of cannabis is permitted by this ordinance and no other commercial cannabis activity is allowed in the City.
Ordinance No. 23-1469 was introduced for first reading by the City Council of the City of Hermosa Beach at its regular meeting held on September 12, 2023 and adopted on September 26, 2023 by the City Council of the City of Hermosa Beach by the following vote: AYES: Councilmember Saemann, Mayor Pro Tem Massey and Mayor Jackson; NOES: Councilmembers Francois and Detoy; ABSTAIN: None ABSENT: None
