NOTICE AND ADOPTION OF ORDINANCE NO. 23-1460

 

AN ORDINANCE OF THE CITY OF HERMOSA BEACH, CALIFORNIA, AMENDING CHAPTER 1.06 (OFFICIAL SEAL AND LOGO OF THE CITY) OF TITLE 1 (GENERAL PROVISIONS) OF THE HERMOSA BEACH MUNICIPAL CODE TO REGULATE THE USE OF CITY INSIGNIA AND FINDING THE SAME EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.

Notice is hereby given that on March 28, 2023, the City Council of the City of Hermosa Beach (“City”) adopted Ordinance No. 23-1460 amending existing provisions of Chapter 1.06 of the Hermosa Beach Municipal Code and finding the same exempt from the California Environmental Quality Act. 

This Ordinance protects against the replication and unapproved use of “City Insignia” as defined therein.  Specifically, this ordinance modifies the Municipal Code to extend similar protections currently applicable to the City’s official logo and seal to other marks, emblems and logos developed by the City to identify official City events or programs.  Violation of this Ordinance is subject to the penalty provisions found in Section 1.04.020, civil penalty up to $1,000.00 or by imprisonment in the county jail for a period not exceeding six (6) months, or by both such fine and imprisonment.

The Ordinance was introduced on March 14, 2023 and adopted on March 28, 2023 by the City Council by the following vote: AYES: Councilmembers Saemann, Francois, Detoy, Mayor Pro Tem Massey, Mayor Jackson; NOES: None; ABSTAIN: None ABSENT: None.

The Ordinance will take effect thirty days after its adoption.
